Legal considerations
Since the ART and Surrogacy Act of 2022,only an ART bank that is not part of an ART clinic can enrol and test ovum or sperm donors.
A donor can donate her oocytes only once
She and her husband or close relative signs a legal affidavit that she is doing so of her own free will and won’t have any claim on the offspring born from her oocytes
The Recipient couple also sign an affidavit saying they wish to use ova from a donor and the child born will be treated as their own. And that they will take responsibility for the donors health upto a year after the stimulation and bear the costs of the treatment needed should any complication arise from the procedure.
An insurance policy in the donors name is made to cover hospital and medical expenses in case of complications
The ART clinic also issues a certificate stating the reason why an ovum donor is needed.
The child born has all legal rights as their own biological child.
Rules are similar for a sperm donor. An insurance is not needed since collection is not an invasive procedure.
All details have to be shared by the Egg or sperm bank with the National ART Registry which is kept in confidence.
Compensation can be given to a donor to make up for work hours lost, travel and for medications.
